New Mexico Bans the Box – Effective June 14, 2019

New Mexico has passed a new law prohibiting all private employers in New Mexico from requesting information about a job applicant’s criminal history during the initial application process. This law is effective June 14, 2019.

This type of rule is commonly known as a “ban the box” law, named for the traditional “yes/no” criminal record checkbox on employment applications.

While the law bans inquiries on the initial application for employment, employers may still gather criminal history from candidates after the application stage. CEDR recommends performing background checks after a conditional offer of employment has been made, following the process outlined in our background checks trainer for our members.
